Col. Edmund Pickens after being duly sworn, deposeth and sayeth:

Robert H. Love came to my house about the time we were trying to organize a company for our county. When we came to the place that was appointed to meet at, there was nobody. Thus when the [INK SPOT]ty commenced between Love & [INK SPOT]egro, they was talking about a horse [INK SPOT] That time I was setting off some distance on a log and subsequently did not hear all that was said. Then Mr. Love went and brought a horse to the place and hitched him, then he went to where the negro Phillip was sitting. Then Phillip run around the house. Then Mr. Love went around after Phillip. Then I heard the sound of a gun or pistol, for I did not see either, though I heard the report and I did not know who was hit or whether any was killed or not. That is all I known about the case.

Judge Question: Did you see Robert H. Love with a pistol?

Answer: I did not.

Attorney Question: Did you tell Mr. Love as you came together, to watch out for the negro?

Ans: Yes, I did.

Qus: What was your object for telling Mr. Love this? Did hear any threats from the negros?

Ans: Yes, I heard threats through rumors.

Qus: Did you hear Phillip say or any other negros day that Phillip threatened Mr. Love for taken him to Vann Buren for stealing a horse?

Ans: No, I did not, but heard through rumor that the negros was excited about it.

Qus: Did you hear before that morning that Len Willis was killed?

Ans: Yes, I did.

Qus: Did you hear was supposed to have killed Len?

Ans: I heard that Phillip & Len left Washita together and the general susposistion was that Phillip killed Len.

Simmon Love, a freedmen, after sworn says:

I went with Mr. Love to Phillip's house and Mr. Love asked Phillip about a horse and Phillip told him where the horse was and Mr. Love went and brought the horse and hitched him. And then went to where Phillip was and Phillip run off and Mr. Love run off after him. And I heard the report of a pistol or gun and I did not know which one of them made the report or whether it was somebody else. And I don't know whether Phillip was hit or whether he is dead or not.

Question by Judge O. Love: Was there any other person there?

Ans: Yes, Priday was there.

Question by Attorney: Where was the woman at the time?

Ans: Out of doors.

Qus: Did this woman see what taking place between Mr. Love & Phillip?

Ans: I don't know.

Qus: Did you hear that Len was killed?

Ans: Yes, I did.

Qus: Who did you hear say that Len was killed and his body found?

Ans: I heard (G.?) D. James tell uncle Williams.

The above case is discharged as there is no evidence justifying further trial.
