She married twice. She married David W. Wall.(1003) (David W. Wall is #3111.) David was born in MS, 1 JUL 1811.(1004) David(1005) was the son of Noah Wall and Lucretia 'Lucy' Folsom. David died 25 JUL 1853 in Preston, TX, at 42 years of age.(1006) His body was interred JUL 1853 in Fort Washita, Chickasaw Nation, IT.(1007) He was listed as a resident in the census report in Choctaw Academy, Scott Co., KY, 31 OCT 1826.(1008) According to conflicting evidence, he married an unknown person in Grayson Co., TX, 3 DEC 1846.(1009) David's will was probated in Sherman, Grayson Co., TX, 30 JUN 1857.(1010) On 3 FEB 1874, Eugenia L. Dechard, by her attorney Robert H. Love, filed the following affidavit in the Pickens County, Chickasaw Nation, Indian Territory Records. It was part of a law suit, Dechard vs Roff, involving property rights.
"To the Hon County Court of Pickens Chickasaw Nation. Before the year of 1845, David Wall did in the State of Alabama Marry one Mrs Brushear, after marriage with the said Brushears, Wall did take up with a younger sister of his wife and came to the Choctaw Nation, here and of that conduct was a child born, Jack Juzan (Alias) Jack Wall. She died and the said Wall went back to Alabama and lived with his wife for a short time and came to the Chickasaw District, Choctaw Nation, and married Mrs Susan Guess. She died and said David Wall married one Miss Bailey of Texas about 1846. Said David Wall was never divorced from Mrs Brushears up to his death in 1853. His marriage to Miss Baily was illicit and the issue illegitimate...."
Eugenia Dechard was a daughter of Robert H. Love. Mrs. Guess (Guest) was Susannah "Susan" Allen. Miss Baily was Nancy Baily and the daughter of David Wall and Nancy Baily was Anna Wall. Anna married Joseph T. Roff, the other party to the lawsuit.
It is unknown at this time who Mrs. Brushears was or who her sister was. It is known that David Wall married Mrs. Guess'(Guest) sister Tennessee Allen after Susan died. [See Marie King Garland, "Chickasaw Loves and Allied Families"] It is possible that the affidavit is correct or is confusing certain facts with the Allen sisters.
What Mrs. Dechard's affidavit fails to mention, and I am sure her attorney was well aware of the fact, is that Chickasaw Law allowed polygimous marriages up until about 1855. Therefore, David Wall could have all the wives he wanted and his children would not be illigitimate. It has now been determined, (see, Don Martini, "The Southern Indians"), that "Mrs. Brushears" is in fact Delilah Juzan, (daughter of Charles Juzan), who was the widow of Jesse Brashears. Which of her known sisters, or unknown sister or sisters, the affadavit of Mrs. Dechard is alluding to is still unknown. It should be noted, however, that on the 1856 Choctaw Roll, (commonly called the 1855 Roll), that there is a Jackson Wall living in the household of A. W. Gary and wife Lucy. Lucy is Lucy Juzan, a sister to Delilah Juzan. Lucy could be this sister.
She married John Richard Overton in Monroe Co., MS, 9 OCT 1834.(1011) (John Richard Overton is #1202.) John was born in Nashville, TN, circa 1800. John(1012) was the son of John Overton. John's occupation: lumberman. John applied for a marriage license to wed Tennessee Allen in Monroe Co., MS, 2 OCT 1834. According to conflicting evidence, he married Tennessee Allen in Monroe Co., MS, 2 OCT 1834.(1013)
Probable son of John OVERTON. Removed with his family in early 1840's to Indian Territory. Settled his family on a farm near Colbert, Indian Territory, (now in Bryan Co., OK). He remained but a short time, when he abandoned his adventure among the Chickasaw and returned to the ways of his early life in Tennessee, never again to have contact with his family in the west. His wife died a short time after he left. (Chronicals of Oklahoma, Vol. XVI, p. 221).
