631. Rebecca⁵ Burney (Judge David Calhoun⁴, Margaret 'Peggy'³ Allen, Susan 'Susy'² Colbert, James Logan¹)⁽⁴⁷⁶⁹⁾ (#52) was born in MS APR 1841.⁽⁴⁷⁷⁰⁾ Rebecca died 4 MAY 1919 in OK, at 78 years of age.⁽⁴⁷⁷¹⁾ Her body was interred 5 MAY 1919 in Masonic Cemetery, McAlester, Pittsburg Co., OK.

She married twice. She married ??? McLaughlin before 1872. (??? McLaughlin is #1512.) ??? died before 1872.

J. J. McAlester's testamony before the Dawe's Commission hearing was that he was the second husband of Rebecca Burney. She was married first to a McLaughlin, who had died prior to their marriage.

She married Col. James Jackson McAlester in Perryville, Choctaw Nation, IT, 22 AUG 1872.⁽⁴⁷⁷²⁾ They had five children, three living in 1927. (Col. James Jackson McAlester is #54.)

James was born in Sebastian Co., AR, 1 OCT 1841.⁽⁴⁷⁷³⁾ James⁽⁴⁷⁷⁴⁾ was the son of William McAlester and Elizabeth Holcomb. James died 20 SEP 1920 in McAlester, Pittsburg Co., OK, at 78 years of age.⁽⁴⁷⁷⁵⁾ Chronicals of Oklahoma article, (Vol. 5, no. 3, p. 352, SEP 1927), states he died on 22 SEP 1922(?). Another source says he died 21 SEP 1920?

His body was interred SEP 1920 in Masonic Cemetery, McAlester, Pittsburg Co., OK. James's occupation: United States Marshal in IT, 1893-1897. James enrolled in McAlester, Tobucksy Co., Choctaw Nation, IT for the Dawes Chickasaw Roll on OCT 1898 and appears on Dawes card number 1125.⁽⁴⁷⁷⁶⁾ He was listed as a resident in the census report in McAlester, Tobucksy Co., Choctaw Nation, IT, 1900. James was elected in OK, 9 JAN 1911.

Conflicting evidence states that Rebecca was born in MS, 7 JUN 1841. She was listed as a resident in the census report on '1855' Choctaw Roll, Chickasaw District, IT, DEC 1856. Rebecca enrolled in McAlester, Tobucksy Co., Choctaw Nation, IT for the Dawes Chickasaw Roll on OCT 1898 and appears on Dawes card number 1125.⁽⁴⁷⁷⁷⁾ On 2 JUN 1903, Rebecca Burney, made the following affidavit in the T.P. Brown enrollment case.

"My names is Mrs. J. J. McAlester. I am both Chickasaw and Choctaw Indian by blood. I knew a Choctaw Indian by blood in the Chickasaw Nation by the name of John Pitchlynn. I do not know what relationship he was to P. P. Pitchlynn. He was 22 or 23 years old when I knew him about 30 years ago. He is dead now. John Pitchlynn married Elizabeth Harris. She was a Chickasaw. Dr. Hiram Pitchlynn, who lived at Green Castle, Indiana was a first cousin of my mother's. Dr. Hiram Pitchlynn was related in some way to John Pitchlynn, but I do not know what the relationship was. This John Pitchlynn was the only one by that name I ever knew. I never knew a Jack Pitchlynn. I never heard of Margaret or Peggy Pitchlynn. I never knew Roland Brown and never heard of him. I do not know the name of Hiram Pitchlynn's father. His mother was a Colbert. She was my great-Aunt, being a sister to my grandmother."

As it is known that Rebecca's paternal grandmother was Margaret "Peggy" Allen, an only child, then Rebecca must have been talking about her mother's, (Lucy James) mother and sister.

Hiram Pitchlynn's father was John "Jack" Pitchlynn, Jr., (not the same John as mentioned above). He married a daughter of Levi Colbert, named Leila. If the above information is correct then Lucy James' mother was a sister of Lelia Colbert and a daughter of Levi Colbert.

We find that Levi Colbert had a daughter named Charlotte "Lotty" Colbert who married a Davis James. This would seem to be the likely parents of Lucy James, based upon the above information.

Rebecca Burney and Col. James Jackson McAlester had the following children:

1569 i. Susan "Sudie"⁶ McAlester⁽⁴⁷⁷⁸⁾ (#1043) was born in IT circa 1874. She married ??? Barnes. Chronicals of Oklahoma, Vol. 5, no. 3, p. 352, SEP 1927, calls her Susan McAlester Barns. (??? Barnes is #27545.)

Susan enrolled in McAlester, Tobucksy Co., Choctaw Nation, IT for the Dawes Chickasaw Roll on OCT 1898 and appears on Dawes card number 1125.⁽⁴⁷⁷⁹⁾

1570 ii. twin McAlester (#29538) was born in IT circa 1874. Twin died circa 1874.⁽⁴⁷⁸⁰⁾ Died in infancy.

+ 1571 iii. James Burney McAlester was born 7 JUN 1876.

+ 1572 iv. William Berry McAlester was born NOV 1880.
