Judge David Calhoun⁴ Burney (Margaret 'Peggy'³ Allen, Susan 'Susy'² Colbert, James Logan¹)⁽²⁴⁸⁹⁾ (#34) was born in MS 1820.⁽²⁴⁹⁰⁾ David died 1871 in Aylesworth, Pickens Co., Chickasaw Nation, IT, at 51 years of age.⁽²⁴⁹¹⁾ His body was interred 1871 in Archerd Cemetery, Linn, Marshall Co., OK.⁽²⁴⁹²⁾

He married twice. He married Lucy James in MS, circa 1834.⁽²⁴⁹³⁾ (Lucy James is #50.) Lucy was born in MS.⁽²⁴⁹⁴⁾ Based on the affidavit of Rebecca [Burney] McAlester that her grandmother was a sister of Lelia Colbert, daughter of Levi Colbert, and eliminating her paternal grandmother, Margaret Allen, who was an only child, thus Rebecca must have ment the mother and sister of her mother, Lucy James, it then seems very possible that Charlotte Colbert, sister of Lelia Colbert, who married Davis James, was mother of Lucy James.

Lucy⁽²⁴⁹⁵⁾ was the daughter of Davis James and Charlotte 'Lotty' Colbert.

Lucy died 1845 in IT. He married Emily Love in IT, circa 1846.⁽²⁴⁹⁶⁾ (Emily Love is #114.) Emily was born in MS, 24 FEB 1827.⁽²⁴⁹⁷⁾ Emily⁽²⁴⁹⁸⁾ was the daughter of Isaac Love and Eliza McKinney. Emily died 23 MAR 1884 in Burneyville, Pickens Co., Chickasaw Nation, IT, at 57 years of age.⁽²⁴⁹⁹⁾ Her body was interred MAR 1884 in Gaines/Burney Cemetery, Burneyville, Love Co., OK.⁽²⁵⁰⁰⁾ She was listed as a resident in the census report on '1855' Choctaw Roll, Chickasaw District, IT, DEC 1856.

He was listed as a resident in the census report in Chickasaw Co., MS, 1840.⁽²⁵⁰¹⁾ David immigrated, 1844. Destination: destination unknown.⁽²⁵⁰²⁾ David's occupation: Farmer/Judge in Chickasaw Nation, IT, before 1871.
