To the Honorable James H. Mars, Judge of Probate for the County of Grayson & State of Texas, in vacation.
Your Petitioner F. Colbert would respectfully represent to your Honor that he is the eldest son of Martin Colbert who departed this life some time in the year 1840 in the State of Mississippi, intestate, leaving Sally Oxberry, Sally Allen & Lucy Allen his three wives and widows, also leaving Eight children all minors under the age of twenty one years, four by Sally Allen and four by Lucy Allen, and your petitioner would further represent to your Honor that Felix Lewis and Nathaniel Anderson applied to the Honorable the Judge of the Probate Court for the County of Desoto & State of Mississippi for Letters of Administration upon the Estate of Martin Colbert Deceased and obtained same and proceeded to administer on said Estate agreeable to the Existing Laws of the State of Mississippi aforesaid, and your petitioner further represents to your Honor that some time in the year 184_, Lucy Allen, one of the said wives & widows of Martin Colbert, late decd., intermarried with one Joshua Murray, and some time in the year of 1844, said Lucy Murray, late Lucy Allen, departed this life leaving her four children Herein named, her sole heirs at law, as there was a marriage Contract between her and the sd Joshua Murray as your Petitioner is informed and verially believes, your petitioner would represent to your Honor that after the death of said Lucy Murray, late Lucy Allen, one John H. Morgan became the administrator of said Lucy's Estate, all of which your petitioner has been informed and verially believes.
Your petitioner would respectfully represent to your Honor that the sd several administrators have paid off all of the debts of said Estates, with the exception of one small debt which is now in the hands of one of sd Administrators, and as your petitioner is informed there is after a final settlement of said Estates with said Probate Court, a large amount of property consisting of Land, negroes & goods & chattles, left for the minor heirs of said Estate now in the State of Mississippi in the hands of said administrators, your petitioner prays your Honor to grant him Letters of Guardianship for all of sd minor heirs, so that the ends of Justice and equity may be had in the premises and your Petitioner as in duty bound will ever pray &c.
